Terms of Service

By accessing or using the Weariq AI platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to all of these Terms, you may not access or use the Service.

We reserve the right to update or modify these Terms at any time. When we make material changes, we will notify you by email or by posting a notice on our website at least 14 days before the changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

These Terms constitute a legally binding agreement between you (“User”, “you”) and Weariq AI (“Company”, “we”, “us”).

To use certain features of the Service, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information.
• Maintain the security of your account credentials.
• Promptly update your account information if it changes.
• Accept responsibility for all activities that occur under your account.
• Notify us immediately of any unauthorized use of your account.

You may register using your email address or through third-party authentication providers (e.g., Google, GitHub). We are not responsible for the privacy practices or security of third-party authentication providers.

You must be at least 13 years old (or the applicable age of digital consent in your jurisdiction) to create an account.

Weariq AI provides an AI-powered virtual try-on service that allows users to:

• Upload photos of themselves and garment images.
• Generate AI-powered virtual try-on images showing how selected garments would look on them.
• View and manage their try-on history.
• Download generated results.

Virtual try-on results are AI-generated approximations and may not perfectly represent actual garment fit, color, or appearance. Results are intended for visualization purposes and should not be relied upon as a guarantee of fit or appearance.

Our Service operates on a credit-based system:

a) Subscription Plans

• Free (Starter) — includes a limited number of free credits per month. No payment required.
• Pro — monthly or annual subscription with a higher credit allocation. Credits reset each billing cycle.
• Business — monthly or annual subscription with the highest credit allocation and additional features.

b) Credit Consumption

• Each virtual try-on generation consumes credits as specified in your plan details.
• Subscription credits that are not used during a billing cycle do not roll over to the next cycle.
• Purchased credit top-ups do not expire and remain in your account until used.

c) Payments & Refunds

• All payments are processed securely through Paddle, our Merchant of Record. We do not store your credit card details.
• Subscription fees are billed in advance on a monthly or annual basis.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you retain access until then.
• Refunds for subscription payments may be requested within 14 days of purchase if you have not consumed a significant portion of your credits. Refund requests are handled on a case-by-case basis.
• Purchased credit top-ups are non-refundable once credits have been consumed.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Upload images that you do not own or have the right to use.
• Upload images containing nudity, explicit content, or images of minors.
• Use the Service to create deceptive, misleading, or fraudulent content.
• Attempt to reverse-engineer, decompile, or extract our AI models or algorithms.
• Use automated tools (bots, scrapers) to access the Service without our written consent.
• Circumvent or disable any security features, rate limiting, or access controls.
• Use the Service in any way that could damage, disable, or impair our servers or networks.
• Resell, sublicense, or redistribute the Service or access to it without our authorization.
• Impersonate another person or misrepresent your affiliation.
• Violate any applicable law, regulation, or third-party rights.

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.

a) Your Content

• You retain full ownership of the images you upload to the Service.
• By uploading images, you grant Weariq AI a limited, non-exclusive license to process your images solely for the purpose of generating your virtual try-on results.
• This license terminates when you delete the images or your account.

b) Generated Results

• Starter plan: Generated try-on images are licensed for personal, non-commercial use only.
• Pro and Business plans: Generated try-on images include a commercial license, allowing you to use them in marketing materials, e-commerce listings, social media, and other commercial purposes.

c) Our Platform

• The Weariq AI platform, including its design, branding, logos, AI models, algorithms, and underlying technology, is the exclusive property of Weariq AI and is protected by intellectual property laws.
• Nothing in these Terms grants you any right to use our trademarks, logos, or branding without written permission.

Your privacy is important to us. Our collection and use of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to our data practices as described in the Privacy Policy.

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. We disclaim all warranties including, but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Guarantees that the Service will be uninterrupted, error-free, or secure.
• Accuracy or reliability of AI-generated virtual try-on results.

Virtual try-on results are AI-generated approximations. We do not guarantee that the results will accurately represent how a garment will look or fit in reality.

To the maximum extent permitted by applicable law, Weariq AI and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to:

• Your use of or inability to use the Service.
• Any errors, inaccuracies, or omissions in AI-generated content.
• Unauthorized access to or alteration of your data.
• Any third-party conduct or content on the Service.
• Any loss of data, revenue, profits, or business opportunities.

Our total cumulative liability shall not exceed the amount you have paid to Weariq AI in the 12 months preceding the claim.

You agree to indemnify and hold harmless Weariq AI and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

• Your use of the Service in violation of these Terms.
• Content you upload to the Service.
• Your violation of any applicable law or third-party rights.

• By you: You may close your account at any time by contacting us or through your account settings. Any active subscription will be cancelled, and remaining credits will be forfeited.
• By us: We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or if required by law. In cases of serious violations, termination may be immediate and without notice.
• Effect of termination: Upon termination, your right to use the Service ceases immediately. We will delete your data within 30 days in accordance with our Privacy Policy.

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from or related to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration or in the courts of the jurisdiction where Weariq AI is registered.
